Preamble

These General Terms and Conditions of Sale are concluded between, on the one hand, Galerie Chastel-Marechal SAS with a capital of € 8,000 RCS: 478 244 429 Paris – Headquarters: 5 rue Bonaparte- 75006 Paris, telephone: 01 40 46 82 61, hereinafter referred to as the Gallery, and on the other hand, customers wishing to make a purchase via the Galerie Chastel-Marechal online store, hereinafter referred to as “the buyer”.
These GTC are intended to define the rights and obligations of the Gallery and of the buyer in the context of a distance sale of goods, offered by the Gallery on the site www.chastel-marechal.com (hereinafter referred to as the “Site”), from ordering to customer service, including payment and delivery.

Certain provisions of the T & Cs include mandatory provisions of the Consumer Code and only apply to consumer customers to the exclusion of professional customers. These are provisions 10 to 13 inclusive of these T & Cs.

2 Supply and availability of goods

The Gallery offers for sale on its site works of art, catalogs, art books which are movable goods, hereinafter referred to as goods.
Offers of goods are valid as long as they are visible on the Site.
The goods are offered for sale in the following countries: France, European Unions.

3 Ordering goods

Any order placed on the site www.chastel-marechal.com constitutes the formation of a contract concluded at a distance between the buyer and the Gallery, and necessarily implies the irrevocable acceptance by the buyer, without restriction or reservation, of the Conditions. General Sales (GTC).

In order to allow the buyer to know the goods he wishes to buy before ordering them, the site www.chastel-marechal.com presents the characteristics of the goods offered for sale: artist, date of creation, number (in the numbered prints), dimensions, materials, and includes photographs of the goods.

The buyer is invited to refer to the description of each property in order to know its properties and particularities, in particular as regards the desired characteristics. The buyer can request the Gallery by email or phone for any further explanation.

Any order implies acceptance of the prices and description of the goods available for sale.

The buyer has the option of modifying his basket before final validation, this last step formalizing the buyer’s order.

The sale will only be considered final after the gallery has sent confirmation of acceptance of the order by email and after receipt of the full price by the gallery.

The gallery undertakes to honor orders received on the website only within the limits of available stocks of goods.
In the case of works of art and catalogs or limited edition or unreedited works, the goods chosen by the buyer are not substitutable with an equivalent good.

4 Placing the order

The buyer places his order for one or more goods offered for sale on the Site.The online ordering procedure includes the following steps:

3: Shipping costs

4: Validation of the order summary

6 Tariffs and terms of payment

Offers of goods are valid as long as they are visible on the site, within the limits of available stocks. The Gallery reserves the right to modify the prices at any time.

When ordering, the buyer is invited to ensure that the price of the goods to which he refers corresponds to the price appearing on the updated page of the site www.chastel-marechal.com and not on an expired page to which he would have accessed through an internet search in so-called “cache” mode.

The delivery costs are indicated on the site www.chastel-marechal.com and are expressed inclusive of all charges. These costs are the responsibility of the buyer and are invoiced in addition to the sale price of the goods. The buyer will be informed before the final registration of his order of the delivery costs related to his order, and payment will be requested from the buyer for the total amount of the purchase.

The goods for sale are invoiced on the basis of the prices in force at the time of the validation of the order by the buyer. The price indicated when placing the order and confirming it in the order confirmation email sent by the Gallery is the final price in euros, all taxes included, handling and delivery costs included.

However, customs fees are not included.

The data communicated by the buyer and recorded by the Gallery when ordering constitutes proof of transactions between the Gallery and the buyer.

After validation of the order by the buyer, the Gallery will send a confirmation email to the buyer to notify him that the order has been registered.

The price of the goods purchased is payable in cash, in full on the day the order is placed by the buyer. The Gallery will not be required to deliver the goods ordered by the buyer if the price has not been paid in full beforehand. Ownership of the goods is transferred to the buyer only after full payment of the price by the latter.

The transfer of the risks of loss and deterioration of the goods will be made upon delivery and receipt of the goods by the buyer.

7 Payment methods

The buyer pays for his purchases: online when ordering by credit card:
The buyer has the possibility to pay by Carte Bleue, VISA, Master Card.
The Gallery ensures the security of transactions by relying on high-performance technical solutions:

The buyer’s account will be debited when the order is placed. Payment is made exclusively in euros.
In case of exhausted or unavailable goods, a refund will be made. The refund will be made within a maximum period of 14 days from the date of the order.
The buyer can access his invoice on the site www.chastel-marechal.com by accessing his customer account.

 

8 Delivery

The goods acquired by the buyer will be delivered within a maximum period of thirty days following the day of the order to the address indicated by the buyer when ordering on the site www.chastel-marechal.com.

If this period is exceeded, not justified by a case of force majeure, the buyer may request the resolution of the sale under the conditions provided for in Article L. 216-2 of the Consumer Code and obtain reimbursement of the costs. sums paid on the occasion of the sale.

Orders are shipped within 72 hours (subject to availability) by the DHL / FEDEX carrier or by Colissimo. The package will be delivered to the buyer against signature.
After placing an order, when the delivery is scheduled, the buyer will receive a message from the carrier specifying the tracking number of the package.

If the package cannot be delivered, if the buyer is absent during the various presentations, the package will be returned to the sender and the buyer will be reimbursed for his order, excluding shipping costs which will remain at his expense. He will have to re-order to receive the unrecovered merchandise on time.

Except in special cases or unavailability of one or more goods, the goods ordered will be delivered in one go. The buyer is required to check the condition of the goods delivered.

9 Verification of the Order on arrival and reservations to the carrier

10 Lack of conformity of the goods with the contract

The buyer must ensure that the goods delivered to him correspond to the order. In accordance with article L217-8 of the Consumer Code, in the event of non-compliance of the goods with the specifications mentioned on the site (and included in the order acceptance email sent by the Gallery), the buyer has a period of 2 years from delivery to form by registered mail addressed to

After this period and failing to comply with these formalities, the goods will be deemed to comply and no complaint can be validly accepted by the Gallery.

11 Repair of the lack of conformity with the contract

In the event of a lack of conformity, the purchaser is entitled either to bringing the good into a compliant condition, free of charge, by repair, or to an adequate reduction in the price or to the termination of the contract with regard to this good.

Initially, the consumer has the right to demand from the Gallery the repair of the good without charge, unless this is impossible or disproportionate.

As the goods are works of art, their replacement is impossible.

Any repair is carried out within one month of the buyer’s complaint and without major inconvenience for the latter, taking into account the nature of the good and the use sought by the buyer.

The buyer may demand an adequate reduction in the price or the termination of the contract if the repair of the good cannot be made within a period of one month or if it cannot be done without major inconvenience to him.

In the event of termination of the sales contract for lack of conformity, the Gallery will reimburse the goods delivered for which the lack of conformity has been duly proven by the purchaser, as well as the costs of delivery and return of the goods.

12 Right of withdrawal

In accordance with article 9 of the directive of October 25, 2011 and articles L221-18 to L221-28 of the consumer code, the buyer has a period of fourteen calendar days to exercise his legal right of withdrawal and return, at his expense, the good (s) of his order does not suit him, for any reason whatsoever under the conditions defined below.

13 Effects of withdrawal

In the event of exercise of the right of withdrawal, the buyer may obtain a refund of the returned good (s) as well as the corresponding standard delivery costs (the cheapest delivery costs offered on the Site).
The refund is made on the bank card used for payment and occurs upon receipt of the good (s) subject (s) of the withdrawal or proof of dispatch of the said good (s) ( s) that the buyer will have communicated by email or post to the contact details specified above.

The costs of returning the said good (s) remain the responsibility of the buyer.

14 Personal Data

The buyer is informed that the information relating to his order is subject to automated data processing.

This contract is governed by French law to the exclusion of any rules of foreign law, including those designated by conflict of law rules.
